End User License Agreement

This End User License Agreement ("EULA") is a binding agreement between you ("you," "the user") and Restorae ("Restorae," "we," "us") that governs your use of the Restorae mobile application binary ("App"). It supplements, but does not replace, the Terms of Service and the Privacy Policy. Where this EULA conflicts with those documents, those documents control on the specific point of conflict.

Apple-required terms (iOS only)

For users who download the App from the Apple App Store, the following Apple-required provisions apply, in addition to the rest of this EULA:

• Acknowledgment. You and Restorae acknowledge that this EULA is concluded between you and Restorae only, and not with Apple. Apple is not responsible for the App or its content. To the extent this EULA grants any rights or licences, they apply against Restorae, not Apple.
• Scope of licence. The licence granted to you for the App is limited to a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions.
• Maintenance and support. Restorae is solely responsible for providing any maintenance and support services with respect to the App, as specified in this EULA, the Terms of Service, or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services in connection with the App.
• Warranty. Restorae is solely responsible for any product warranties, whether express or implied by law, that are not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product claims. Restorae, not Apple, is responsible for addressing any user or third-party claims relating to the App or the user's possession or use of the App, including product-liability, consumer-protection, and intellectual-property claims.
• Intellectual-property infringement. In the event of any third-party claim that the App or your possession or use of the App infringes that third party's intellectual-property rights, Restorae — not Apple — will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
• Compliance with laws. You represent and warrant that (i) you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country, and (ii) you are not listed on any US Government list of prohibited or restricted parties.
• Third-party beneficiary. You and Restorae acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance of this EULA Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

Licence grant

Subject to your compliance with this EULA, Restorae grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on a device you own or control, for your personal, non-commercial use, for the duration of your account.

Restrictions

You agree that you will not, and will not enable any third party to:

• copy, modify, adapt, translate, or create derivative works of the App or any part of it;
• reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of the App, except to the extent (and only to the extent) that this restriction is prohibited by applicable law;
• rent, lease, lend, sell, redistribute, sublicense, or commercially exploit the App;
• remove, alter, or obscure any copyright, trademark, or other proprietary-rights notice;
• use the App in connection with the development of, or comparative testing for, any competing service;
• use any automated means (bots, scrapers, headless emulators) to access the App or its backend;
• use the App to violate any applicable law, including export-control regulations;
• circumvent any security or rate-limiting feature of the App or the backend.

Updates and version support

Restorae may, but is not obligated to, release updates to the App. Updates may be installed automatically by the App Store or Play Store. Restorae may end support for an older version of the App at any time; an unsupported App may stop functioning correctly, and Restorae will not be liable for that. We recommend always running the most recent published version.

Open-source components

The App incorporates open-source software components. Each component is licensed under its own terms; those terms control use of that component. A complete list of open-source components and their licences is available on request from legal@restorae.app.

Termination

This EULA is effective until terminated. Your rights under this EULA terminate automatically and without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and destroy all copies in your possession or control. Provisions that by their nature should survive termination (restrictions, intellectual property, disclaimers, limitation of liability) will survive.

Disclaimers and liability

The App is provided "as is" and "as available." Restorae disclaims all warranties to the maximum extent permitted by law, as further described in the Terms of Service. Restorae's aggregate liability under or in connection with the App is limited as set out in the Terms of Service.

Governing law

This EULA is governed by the laws of the State of Delaware, United States, excluding its conflict-of-laws rules. Disputes are resolved as set out in the Terms of Service (binding individual arbitration administered by JAMS), with the consumer-protection carve-outs described there.
